Melanated TV — Terms & Conditions

Effective Date: September 27, 2025

These Terms & Conditions (“Terms”) govern access to and use of Melanated TV operated by CrownThrive, LLC (“Melanated TV,” “we,” “us,” “our”). By using our websites, subdomains, applications, channels, or services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.


1. Acceptance

These Terms are a binding agreement between you and CrownThrive, LLC. We may update them by posting a revised version. Your continued use after an update constitutes acceptance.

2. Eligibility

You must be at least 18, or the age of majority in your jurisdiction, to use the Service without supervision. Minors may use the Service only with a parent or legal guardian who accepts these Terms.

3. Accounts & Security

  • Provide accurate, current information and keep it updated.
  • Keep your login credentials confidential; you are responsible for all activity under your account.
  • Notify us immediately of any unauthorized use or suspected breach.
  • Accounts are personal; do not sell, rent, or transfer them.

4. Subscription Plans, Promotions & Trials

We offer plans with different features and limits (e.g., devices, profiles, resolution, downloads). Current details and pricing appear on the platform. Trials and promotions may have additional terms. We may modify, add, or discontinue plans or features.

5. Billing, Payments & Taxes

  • Payments are processed by secure providers (e.g., Stripe, PayPal; regional gateways where supported).
  • By subscribing, you authorize recurring charges until you cancel.
  • Keep your billing details current. Failed payments may pause or terminate access.
  • Prices may be subject to sales/VAT and processing fees per our billing policy.
  • Refunds are generally not available except as stated in our Refund, Cancellation & Billing Policy or where required by law.

6. Limited License

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view content for personal, non-commercial use. Public performance, copying, redistribution, or commercial use requires prior written authorization.

7. Intellectual Property

The Service and all content (including films, series, live channels, graphics, software, trademarks, and logos) are owned by us or our licensors and protected by law. No rights are granted except as expressly stated.

8. Acceptable Use

You agree not to:

  • Upload, distribute, or enable malware or harmful code.
  • Circumvent DRM, geo-filters, or security; scrape or harvest data.
  • Share credentials, resell access, or use another user’s account without permission.
  • Engage in fraud, payment abuse, or unlawful conduct.
  • Interfere with Service operation or overload our infrastructure.

9. Features & Availability

  • Devices & Profiles: Limits vary by plan and may be enforced by technical controls.
  • Downloads: Where available, offline downloads are temporary and for personal use on supported apps; device and expiry limits may apply.
  • Geo Availability: Content libraries/features vary by region due to licensing.
  • Quality: Playback resolution depends on device, content, and network (HD/4K/8K where available).

10. Third-Party Services

The Service may link to or integrate with third-party platforms. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and governed by their terms.

11. User-Generated Content

If you submit or upload content (e.g., reviews, comments, creative works), you grant us a worldwide, non-exclusive, royalty-free license to use, host, reproduce, display, distribute, and create derivative works of that content in connection with the Service and our promotions. You represent you have necessary rights and your content does not infringe law or third-party rights. We may remove content that violates these Terms.

12. Privacy & Data

Your use of the Service is governed by our Privacy Policy, Data Deletion & Privacy Rights Policy, and related notices. By using the Service, you consent to the practices described there.

13. Children & Parental Controls

The Service is not directed to children under 13 (or the applicable minimum age in your region). Parental controls and kids’ profiles, where available, help manage access. If we learn we collected data from a child contrary to law, we will delete it.

14. Copyright Complaints

If you believe content on the Service infringes your rights, email a notice with: (a) description of the work; (b) the material and its location; (c) your contact details; (d) a statement of good-faith belief; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act. We may remove content and act against repeat infringers.

15. Disclaimers

The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation.

16. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates/licensors are not liable for indirect, incidental, special, consequential, or exemplary damages (including lost profits, data loss, or service interruptions). Our aggregate liability to you is limited to the subscription fees you paid during the twelve (12) months before the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless Melanated TV, CrownThrive, LLC, and their affiliates, officers, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, misuse of the Service, or infringement of rights.

18. Changes to the Service or Terms

We may change, suspend, or discontinue any part of the Service at any time. Where required, we will provide notice of material changes to these Terms. If you do not agree to changes, stop using the Service.

19. Suspension & Termination

We may suspend or terminate access, with or without notice, if you breach these Terms, engage in harmful conduct, or as required by law or licensing partners. Provisions that by their nature should survive (e.g., IP, disclaimers, limitation of liability, indemnity) will survive termination.

20. Communications & Notices

  • Electronic Notices: You consent to receive disclosures, receipts, and notices electronically.
  • Marketing: You may opt out of marketing emails; essential service notices will continue.
  • Help Center & Chat: Support is available via our access-controlled Help Center at help.crownthrive.com and our AI-powered chatbot (lower-left corner where available). Access can be requested from the Help Center landing page.

21. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Virginia for any action not otherwise subject to mandatory arbitration (if applicable).

22. General Provisions

  • Entire Agreement: These Terms and referenced policies (e.g., Privacy Policy; Refund, Cancellation & Billing Policy; Data Deletion & Privacy Rights Policy) form the entire agreement.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Severability: If a provision is unlawful or unenforceable, it is modified to the minimum extent required; the remainder remains in effect.
  • Assignment: You may not assign these Terms without our written consent. We may assign to an affiliate or in connection with a merger, acquisition, or asset transfer.
  • Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
